    The Book

    The present book looks into the Indian Supreme Court from a non-traditional point of view. The major purpose of the book is to make a survey of the Judicial Behaviour and Judicial Decision Making of the Supreme Court of India. It is an attempt to look to the highest judiciary in India through the lens of behavioural research. When this book was first published in the year 2000 it was the first published book in this area on the Indian Supreme Court. This area was neglected by the Indian researchers in Political Science and Law for quite a significant period of time. It was in fact, a virgin area of research and very few scholars looked into the Indian Supreme Court through this lens. Quite in the contrary, the research on judicial behaviour and judicial decision making was a very common area of research in the United States of America and we find that there are a plethora of works in this field. In the wake of behavioural revolution, the pioneering efforts were taken by leading stalwarts in America in judicial behavioural research. The most important pioneers include Professor C. Herman Pritchett, Professor David J. Danelski, Professor Joel B. Grossman, Professor Sidney Ulmer, Professor Walter F. Murphy and no less than a person like Professor Glendon B. Schubert. These American scholars significantly developed highly sophisticated models for the study of this unexplored field in the American context. But unfortunately, it could not develop much interest among the Indian researchers. From the Indian perspective the credit definitely goes to an American scholar, Professor George H. Gadbois Jr. who applied the new models and techniques to the study of Indian Judiciary. It was Professor Gadbois who can claim the credit of new path breaking trend which inspired Indian scholars like me to look at the Indian Judiciary from a new angle, not following the traditional method of study of the Indian Supreme Court. This book is an attempt to try and explore the undiscovered areas of the Indian Supreme Court, the highest Court in the country. It would serve the purpose of the academicians and the researchers to a great extent. Since this area is fertile for research, it might invite scholars to explore many dimensions of the Supreme Court of India.

    The Authors

    Professor Manas Chakrabarty, is currently Senior Fellow of ICSSR attached to the Department of Political Science, University of North Bengal, Darjeeling, in West Bengal. He was also Emeritus Professor of UGC (2016-2018). Professor Chakrabarty with his thirty-three years of Postgraduate teaching experience has carried out extensive research and he has to his credit 200+ (TWO HUNDRED PLUS) 215 research articles in leading professional national and international journals, FIVE BOOKS and TWENTY-SEVEN chapters in different books. He has delivered more than two hundred Key Note Address in different National and International Seminars and Chaired about one hundred fifty National and International Seminar sessions. Professor Chakrabarty has now completed five Major Research Projects, sponsored by University Grants Commission (UGC) and the Indian Council of Social Science Research (ICSSR).

    His areas of interest are: Indian Government and Politics, Judicial Behaviour and Judicial Decision Making. Trade Unionism, International Politics and Comparative Politics. He was also the Director of the Centre for Nehru Studies and Gandhian Studies (sponsored by the UGC), Coordinator of SAP (DRS Phase-III) sponsored by the UGC. Programme Coordinator, National Service Scheme at the University, Chairperson in Political Science, Directorate of Distance Education, North Bengal University, and Chairman of the Sports Board, North Bengal University. So, far Twenty-Seven scholars have been awarded Ph.D. degree under his supervision and he has also supervised several M.Phil. dissertations. He is the recipient of the INDIAN POLITICAL SCIENCE ASSOCIATION National Award (Life Time Achievement), 2017. He was also the Editor of the Indian Journal of Political Science published by the Indian Political Science Association. (2018-2021). Professor Chakrabarty is a Life Member of the Indian Political Science Association, Indian Institute of Public Administration and the American Studies Research Center.

    Dr. Ruchita Chakraborty is an Assistant Professor at the Campus Law Centre, University of Delhi. She has done her B.A., LL.B. (Hons.) and Ph.D. from the University of North Bengal, Darjeeling, and her LL.M. in Corporate and Business Laws from the Gujarat National Law University. She is also an MBA in Human Resource Management. Before joining the academics, she has a corporate experience in the field of human resource management. In addition to her academic achievements, she has a special orientation for social work. She has worked with the West Bengal Legal Services Authority since the time she was a student. She was mainly dealing with women-related issues in rural areas in North Bengal. She was also a part of the project on gender sensitisation in collaboration with the Coalition Against Trafficking in Women (CATW) which is the first cross-country global network to combat trafficking, prostitution, sex tourism and other violence against women. In this regard, she was the Indian representative for the Asia Pacific Wing of CATW in the year 2011, conference held at Manila, Philippines.

    As an academician, she has a number of publications both at national and international levels to her credit. She also has a huge number of publications in the form of journal articles, book chapters, conference proceedings, etc. She is also involved with a number of journals of national repute in the capacity of an editorial board member. Currently, she is also involved with a major research project in the capacity of Co-Principal Investigator on Sports as a Tool of Women Empowerment: A Study of Policies, Practices and Barriers faced by Women in Sports in India funded by the National Commission for Women. Her areas of interest are Human Rights Laws, Corporate and Business Laws, and Labour Laws.
